Terms of Service

These Terms of Service ("Terms") are an agreement between AutoYield LLC, a Utah limited liability company ("AutoYield," "we," "us"), and the business that signs up for an AutoYield account ("Customer," "you"). By creating an account, paying, or using the service at autoyieldiq.com (the "Service"), you agree to these Terms. If you accept on behalf of a business, you confirm you have authority to bind it.
1. The Service
AutoYield is web-based software that helps auto dealers and lenders estimate deal yield, loan-to-value, payment and tier limits for auto finance deals. The Service is offered to businesses only, not to consumers for personal use.
2. Accounts
Accounts are created through a paid sign-up or an invite link from AutoYield. You choose your own username and password, must keep them confidential, and are responsible for activity under your account. Tell us right away at info@autoyieldiq.com if you believe your account has been used without permission. We may pause or deactivate an account for non-payment, a breach of these Terms, or a security risk.
3. Fees, billing and taxes
The Service costs a one-time setup fee of $500 and a subscription of $199 per month, unless a written order says otherwise. The setup fee and first month are charged at sign-up, and the subscription renews automatically each month until canceled. Payments are processed by Stripe, and by subscribing you authorize recurring charges to your payment method. Prices do not include sales or use tax; applicable taxes (including Utah sales tax on software subscriptions) will be added based on your location. We may change prices with at least 30 days' notice, effective at your next billing period.
4. Cancellation and refunds
You can cancel any time through Manage billing in your account or by emailing info@autoyieldiq.com. Cancellation takes effect at the end of the current paid month, and you keep access until then. The one-time setup fee and all fees already paid are non-refundable, and there are no prorated refunds for partial months, except where required by law. If a payment fails, your account may be paused until the balance is paid.
5. Estimates only; no credit decisions
AutoYield provides calculations and estimates to support your own judgment. It is not a lender, broker, credit bureau or consumer reporting agency, and it does not approve, deny, arrange or fund credit. Results depend on the information you enter and on general assumptions that may not match a particular lender's program. You are solely responsible for your credit, pricing, structuring and compliance decisions, including under the Equal Credit Opportunity Act, Truth in Lending Act, Fair Credit Reporting Act, state dealer and lending laws, and any lender agreements.
6. Your data
You own the deal information you enter ("Customer Data"). You give us permission to store and process it only to provide, secure and support the Service. You are responsible for having the right to enter Customer Data and for not entering more consumer personal information than you need (for example, do not enter Social Security numbers, full account numbers or credit reports). We protect Customer Data as described in our Privacy Policy. If you are a financial institution under the Gramm-Leach-Bliley Act and need a service-provider or data processing agreement, contact us.
7. Acceptable use
You will not: share logins outside your business; resell or sublicense the Service; copy, reverse engineer or scrape it; probe or bypass its security; use it for anything unlawful or discriminatory; or upload malicious code.
8. Our property
AutoYield owns the Service, its software, formulas, design and content. These Terms give you a limited, non-transferable right to use the Service during your subscription. Feedback you send may be used to improve the Service without obligation to you.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, AUTOYIELD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT GUARANTEE ANY DEAL OUTCOME, APPROVAL, YIELD OR UNINTERRUPTED SERVICE.
10. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, AUTOYIELD WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, DATA OR DEALS. AUTOYIELD'S TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE FEES YOU PAID IN THE 12 MONTHS BEFORE THE CLAIM.
11. Indemnity
You will defend and indemnify AutoYield against third-party claims arising from your Customer Data, your credit or pricing decisions, or your breach of these Terms or the law.
12. Term and termination
These Terms apply while you have an account. Either party may end them by canceling. We may suspend or end access for non-payment or a material breach. After termination, we may delete Customer Data 30 days after account closure; ask us before then if you want an export.
13. Changes
We may update these Terms. If a change is material, we will notify you by email or in the Service at least 15 days before it takes effect. Continued use after that means you accept the change.
14. General
These Terms are governed by the laws of the State of Utah. Any dispute will be brought in the state or federal courts located in Washington County, Utah, and both parties consent to that venue. If any part is unenforceable, the rest stays in effect. These Terms are the entire agreement on this subject unless a signed order says otherwise.
